Terms of Use
1. Service scope
The iOS app sends photos, videos, files and eligible text cards you explicitly select. The website and Windows client provide their corresponding sending, receiving and saving functions. Capabilities and limits differ by platform; refer to the actual interface and supported capabilities.
Discovery requires internet access. Content uses verified private-network encrypted direct connections without a file relay. The service does not promise compatibility with every network, indefinite background availability or automatic resending after recovery. An iPhone may go offline when locked or closed; discovery resumes after reopening as network conditions allow.
2. Sending, receiving and acceptable use
Send only content you have the right to use and share, obtain the recipient's consent and check the target device. Do not infringe privacy, intellectual property or other laws. While receiving is enabled, eligible nearby devices can initiate transfers. Pause receiving or close the page when it is not needed.
You can explicitly tap a device to send. Touch to send uses new spacebar requests from the computer and your first approval for the current computer connection on the phone; it does not collect phone motion. While the same connection and approval remain valid, later fresh spacebar requests do not require repeated approval. Approval is revoked when you leave the foreground Send page or disconnect; requests after reconnection or revocation require new approval. Reconnection does not send automatically, and confirmed deliveries are not automatically replayed.
3. Saving files and text cards
Keep backups of important content and confirm it has been saved on the receiving device. Failed or interrupted transfers are not proof of delivery. Temporary browser copies may be lost on refresh or close; files in authorized folders and files already saved by Windows require your own management. A successful send does not automatically delete phone originals.
Text cards are explicitly typed or pasted and limited to 1,048,576 UTF-8 bytes each. Receivers display them temporarily and copy them only on an explicit action. They are not automatically saved as files, included in ZIP files or written to the clipboard. History does not retain text bodies. Copy anything needed before closing or clearing the page.
4. Free limits and Pro purchases
Current iOS Free selections allow up to 10 photos/videos per batch, at most 128MiB each and 1024MiB in total, and do not support file or text-card sending. One MiB is 1,048,576 bytes. Pro capabilities remain subject to device, storage, network and receiver constraints; they do not guarantee unlimited capacity or successful delivery.
Pro is provided through Apple's in-app purchases and enables file and text-card sending and other Pro features shown in the app. Whether a plan is purchasable depends on the storefront, product status and app version; listing a plan does not mean it is available for sale or that you have acquired an entitlement. The price, currency and billing period are those displayed in the app before purchase and on Apple's purchase confirmation screen. Viewing a plan or starting a purchase flow does not grant an entitlement; a completed purchase and valid transaction verification are required.
Monthly and annual plans are auto-renewable subscriptions, renewed and billed for their respective periods unless cancelled under Apple's rules. You can manage or cancel them in Settings on your iPhone, under your Apple Account's Subscriptions, or refer to Apple's cancellation instructions. After cancellation, access ordinarily continues until the paid period ends, subject to the expiry date shown by Apple and a valid entitlement. Uninstalling the app does not cancel a subscription.
The lifetime plan is a one-time purchase of Pro access, does not renew monthly or annually and does not automatically cancel an existing subscription; cancel an existing subscription separately in Apple's subscription settings if you want to stop its renewal. You can verify previous purchases again using Restore purchases in the app with the same Apple Account. Refunds, revocations or subscription expiry may invalidate the corresponding entitlement. Billing and refunds follow Apple's applicable procedures and legal requirements; requests can be submitted through Apple's refund request service. We do not promise that every request will qualify for a refund and do not exclude your statutory refund or other remedy rights.
5. Permissions, third parties and privacy
System permissions, file providers, iCloud, browsers and operating systems affect feature availability and operate under their own rules. Sendby is not Apple AirDrop and does not imply Apple's endorsement. For content, connection information, local storage and logs, read the Privacy Policy.
6. Children, minors and guardians
Sendby is a general-purpose file transfer tool, not specifically directed at children, and does not set its own universal minimum age. Distribution of the iOS version follows its actual App Store age rating, applicable regional distribution rules and parental-control settings; refer to the relevant storefront and applicable requirements. Website and Windows users must also comply with applicable local law.
Minors should understand these terms, choose shared content and recipients, and manage device permissions and purchases with their guardian's knowledge and appropriate guidance. Where the law requires guardian consent for use, purchases or personal information processing, that consent must be obtained. An App Store age rating, download or installation does not replace legally required guardian consent.
Guardians can contact the mailbox below with privacy requests concerning a child in their care. We will verify necessary information and handle the request as required by law. See the Privacy Policy for personal information processing and deletion rules.
7. Failures, responsibility and disputes
We will meet our legal obligations concerning the service, security maintenance and personal information protection. Network, device, storage or third-party failures may cause delay, interruption or failure; follow displayed guidance and confirm receipt and saving. These technical limitations are not a blanket exclusion of liability. If our breach of legal obligations or these terms causes you loss, we will bear the corresponding liability under applicable law.
These terms do not exclude or limit liability that cannot lawfully be excluded or limited, or diminish your statutory consumer rights, guarantees or remedies. Where a provision conflicts with applicable mandatory law, that law prevails.
If a dispute arises, you may contact us through the mailbox below, seek mediation, complain to a competent authority or seek relief from a court with lawful jurisdiction. Applicable law and jurisdiction are determined under the relevant legal rules. These terms do not impose mandatory arbitration, require waiver of statutory remedies or make prior negotiation a prerequisite to exercising legal rights.
8. Updates and contact
We will explain material changes to features, compatibility or these terms, state updated and effective dates, and provide notice as required; where renewed consent is legally required, we will follow those requirements. Updates do not diminish rights already acquired under applicable law. Windows versions that support update checks let you check manually and then explicitly open an official download link; they do not automatically download, install, overwrite the app or restart it. Older clients may not have an update-check control; you can download a new version from sendby.space.
